Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 3-13, s.5. by Philip R. Lindquist, Chairman, in Meeting Room A on the top floor of the Town Hall

Public Hearings

8:00 PM  Notice of Intent for the Waterfront Restoration Project that includes a handicapped ramp and trails for access to the waterfront at Camp Kiwanee, Map 54, Lot 9 for the Hanson Recreation Department represented by David Blauss, Inc., 690 E. Washington St., Hanson, MA  (DEP #SE175-05___)  (New Hearing)

Frank Schellenger read the Public Hearing Notice and the abutters were verified.  Joe Baker made the presentation for what is being called “Phase I” of the Waterfront Restoration Plan.  Presently, all that is being proposed is the revamping of the stairwell from the porch of the lodge down to a viewing platform and then down to the water.  No trees shall be removed and there will be only minimal disruption to the hillside, aside from sonna tubes for the platform.  The 4 or 5 shrubs that must be removed will be transplanted elsewhere on the property.  No heavy equipment will be used.   Mr. Lindquist asked if any abutters were present:

8:15 PM  Continued Notice of Intent for the Taunton Watershed Pilot Wetlands Mitigation Bank which proposes to create 9.3 acres of new wetlands and enhance 16.2 acres of bog to forested wetlands at the Burrage Pond Wildlife Management Area in Hanson by BlueWave Capital, LLC, 137 Newbury Street, fl 7, Boston, MA  02116 represented by Beals & Thomas, Inc., 144 Turnpike Rd., Southborough, MA  (DEP #SE175-0516) – continued per request of applicant to 5/22/07 at 8:45 PM

8:30 PM  Request for Determination of Applicability to determine whether the work depicted on a Plan of Land Off Ferris Street, Map 007, Lot 0017 is subject to the Wetlands Protection Act for J & G Trust represented by Alan Dias, P.O. Box 314, Monponsett, MA  (New Hearing)

Frank Schellenger read the Public Hearing Notice and the abutters were verified.  Alan Dias made the presentation for a proposal to conduct perc tests.   The property is a contractors yard that has an existing foundation as well as an area for equipment storage.  The wetland was delineated by Dr. Walter Hewitson on 1/18/07.  Mr. Dias explained that he would like to continue to use the property as it has been historically, a portion of which is within the 50-foot buffer zone.  The wetland is divided from the yard by an earthen berm.  Mr. Dias agreed that a septic proposal and any other work would require the filing of a Notice of Intent.

8:45 PM  Notice of Intent for the construction of an addition to a single family home within 100 feet of a Bordering Vegetated Wetland at 201 Maquan Street, Map 71, Lot 10 for Brenda Dennison (New Hearing)  (DEP #SE175-0522)

Frank Schellenger read the Public Hearing Notice and the abutters were verified.  Brenda Dennison made the presentation for a proposed 2-car garage with a room over. A silt sack was proposed at the limit of work.  Ms. Delaney, acting as Interim Agent inspected.  She had commented in a site report that the wetland is a possible vernal pool.  Also, she had advised the Dennison’s to dispose of their grass clippings/yard debris elsewhere and not near the edge of the wetland.

Discussion

Conservation Agent – Phil Lindquist had talked to Michael Finglas, Town Administrator.  One of the candidates interviewed was no longer interested while the funding for the position was being determined.
Letter & Pictures regarding Holly Ridge Drive and flooding problems – The Commissioners read the letter and reviewed the pictures.  Ms. Nehiley will call Wade Keene and John Kemmett will inspect.
Police Station – 2nd Request for Information – Still no response.  Dave Harris commented that there is no plan on file showing the changes that were made.
Open Space Plan – RFP – Mr. Lindquist said that this should be put on hold until a new agent is hired as it entails a lot of time and effort.
Request to Extend an Orders of Conditions for West Side of Union St., Map 31, Lots 7A & 6 for Elko Corporation for a 3-year extension  (DEP #SE175-369) –  signed
Duncan Bogs on South Street – Ms. Nehiley had spoken to Linda Rinta of NRCS of the flooding occurring on South Street, possibly caused by the maintenance of the bogs.  Ms. Rinta suggested to call the owners directly and pose the question to them.  
Burrage Pond pictures of possible vernal pool taken by Janine Delaney - The Commission watched the video and pictures that Janine had taken of pollywogs and egg masses.
Community Preservation Act – meeting on June 12th with Housing Authority – duly noted
Letter from Kopelman & Paige regarding Reed Street, Lot 14-3 dated 5/15/07 – duly noted


Blanket Determination of Applicability

14 Adams Circle, Map 122, Lot 102 – Mr. Kemmett will inspect


Enforcement Issues

78 Forest Trail (DEP #SE175-475) –  Mr. Kemmett had driven by this address in response to a neighbor’s Building Permit Application and noticed activity not permitted by the Order of Conditions.  Ms. Nehiley will write a letter to the owners to ask them to respond.
690 High Street (DEP #SE175-276)  - Mr. Lindquist will look into a report of filling of wetlands.
King Street, Bay State Gas – Ms. Delaney had driven by and noticed deterioration of erosion control.  Mr. Lindquist will talk to Carl Aiello of Bay State Gas about the bio-fence.
